I don’t know whether it is legal, but perhaps it was an instance of something “crossing in the mail”. For example, the claim might have been filed on the same day that someone in another department at Capital One accepted your “debt resolution plan”.
I would contact Capital One and make sure that everything is clear, and if the have record of accepting the payment plan, then ask them to drop the lawsuit and to send you verification that it was dropped.

i would contact whoever your using for the ‘debt resolution plan’ and tell them…. they might have really good insights into whats going on
